These Terms of Service ("Terms") govern your access to and use of Zingder (the "Service"), operated by [Your name / legal entity]("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 16 years old (or the age of digital consent in your country) to use the Service. You are responsible for the activity under your account and for keeping your credentials secure. Provide accurate information and keep it up to date.
2. Your content and intellectual property
"User Content" means any material you upload, including sheet music, MusicXML, PDFs, audio/backing tracks, annotations, and text. You retain ownership of your User Content.
You represent and warrant that, for every item you upload, you either own it or hold all rights, licences, consents, and permissions necessary to upload, store, display, and share it within your choir through the Service. Sheet music and recordings are frequently protected by copyright; obtaining the right licences is your responsibility, and the risk and liability for uploading material you are not authorised to use rests entirely with you.
You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce, and display your User Content solely to operate and provide the Service to you and the members of your choir. This licence ends when you delete the content or your account, except for backups retained for a limited period or where retention is required by law.
You agree to indemnify and hold us harmless from any claim, demand, loss, or damages (including reasonable legal fees) arising out of User Content you upload or your breach of these Terms, including any claim that your User Content infringes a third party's intellectual property or other rights.
3. Acceptable use
You agree not to use the Service to:
- upload material you do not have the right to use;
- infringe intellectual property, privacy, or other rights of others;
- upload malware or attempt to disrupt, probe, or gain unauthorised access to the Service;
- misuse automated or AI features to generate excessive load or circumvent usage limits;
- use the Service for unlawful, harmful, or harassing purposes.
4. Copyright and takedown
We respect intellectual property rights. If you believe content on the Service infringes your copyright, contact us at [your-contact-email] with enough detail to identify the material and your rights in it. We may remove allegedly infringing material and may suspend or terminate accounts of repeat infringers.
5. AI-assisted features
The Service may offer AI-assisted features (such as score analysis or vocal coaching suggestions). These are provided for convenience and may be inaccurate or incomplete. They are not a substitute for professional judgement, and we do not guarantee any particular result. Usage limits may apply.
6. Service availability and changes
The Service is offered during an ongoing development/beta period and may change, be interrupted, or be discontinued at any time. We may add, modify, or remove features without notice. We are not responsible for any loss resulting from downtime or changes.
7. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that stored content will not be lost.
8. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law (such as for death or personal injury caused by negligence, or for fraud).
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users.
10. Governing law
These Terms are governed by the laws of Belgium, without regard to conflict-of-law rules, and the competent courts of Belgium will have jurisdiction, subject to any mandatory consumer-protection rights you have where you live. [Confirm jurisdiction with your lawyer.]
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify you, and continued use after the changes take effect constitutes acceptance.
